General Terms and Conditions of the Dutch Companion Animal Database Foundation (NDG)

GENERAL PROVISIONS

A1.
These general terms and conditions apply to every registration, offer, quotation, or other type of agreement between a user (the registrant) and NDG.

A2.
The NDG register is not a register of ownership for companion animals.

A3.
The registrant is always personally responsible for the registration and any changes to it.

A4.
Changes can only be submitted by the person in possession of a registration certificate and a safecode. Only this registrant will be provided with the registration proof and additional details necessary to process changes. Handling of this confidential information is entirely at the registrant’s own risk. Please note that administration fees will be charged for address changes, partly due to the issuance of a new card with a new safecode.

A5.
In case of possible disputes regarding a registration or if the registrant cannot be identified, NDG may place the relevant registration in quarantine. The registration can then, in principle, only be modified by a joint request from the registrant (or their legal successors) and the third party, or through a final court ruling.

A6.
NDG always reserves the right to refuse or alter a registration. The registrant acknowledges that NDG is never liable for incorrect or incomplete registrations.

SPECIAL PROVISIONS

B1.
The fee associated with the registration must be paid before NDG proceeds with the registration.

B2.
NDG determines the registration fee, registration duration, and the deregistration moment. NDG is also entitled to implement changes when required by government regulations, or if it deems them necessary itself.

B3.
In the database operated by NDG, the pet’s identification number is linked to the registrant’s address details. A privacy statement applies to this, which forms an integral part of these general terms and conditions and can be viewed on the NDG website (www.NDG.nl).

B4.
NDG is never liable for damage resulting from incorrect or incomplete registrations, as the data is provided by the registrant themselves.

B5.
NDG’s liability for (direct) damages is in any case always limited to the registration fee. Indirect damages are expressly excluded.

B6.
Every registrant indemnifies NDG against possible claims from third parties related to the relevant registration.

B7.
All legal relationships between NDG and a registrant are governed exclusively by Dutch law. In the first instance, the matter must be submitted to the court competent under Dutch law.
